PART V.Β Β LICENSING OF AMUSEMENT DEVICES β€” WASHINGTON COUNTY.

Β§ 17-441. Definitions.
(a)Β In general. β€” In this part the following words have the meanings indicated.
(b)Β Amusement device. β€”
(1)Β β€œAmusement device” means:
(i)Β a billiard table; or
(ii)Β a game activated by coins, tokens, or other objects or consideration of value.
(2)Β β€œAmusement device” includes:
(i)Β a video game;
(ii)Β an electronic game;
(iii)Β a claw machine;
(iv)Β a bowling game;
(v)Β a shuffleboard game;
(vi)Β a pool table;
(vii)Β a pinball machine;
(viii)Β a target machine;
(ix)Β a baseball machine; and
(x)Β any other similar device.
(3)Β β€œAmusement device” does not include a vending machine in which amusement features are not incorporated.
(c)Β Amusement device operator license. β€” β€œAmusement device operator license” means a license issued by the County Commissioners of Washington County to operate an amusement device in Washington County.
(d)Β Amusement device permit. β€” β€œAmusement device permit” means a permit issued by the County Commissioners of Washington County to allow the public use of an amusement device in Washington County.

Β§ 17-443. Amusement device operator license
(a)Β In general. β€” Whenever a person operates an amusement device in Washington County, the person must have an amusement device operator license.
(b)Β License requirements. β€”
(1)Β An applicant for an amusement device operator license shall:
(i)Β apply to the county commissioners on the form that the county commissioners require; and
(ii)Β pay a license fee of $ 25.
(2)Β An application for an amusement device operator license shall contain:
(i)Β the name and address of the applicant;
(ii)Β the name and address of each location where amusement devices are to be operated by the applicant; and
(iii)Β any other information that the county commissioners require.
(c)Β Term of license; renewal. β€”
(1)Β Unless an amusement device operator license is renewed for a 1-year term as provided in this subsection, an amusement device operator license expires on June 30 after its effective date.
(2)Β Before an amusement device operator license expires, the licensee may renew it periodically for an additional 1-year term if the licensee:
(i)Β applies to the county commissioners on the form that the county commissioners require; and
(ii)Β pays to the county commissioners a renewal fee of $ 25.

17-444. Amusement device permit.
(a)Β In general. β€” Whenever a person keeps, owns, or maintains an amusement device, before the person allows the public use of the amusement device in Washington County, the person must have an amusement device permit.
(b)Β Permit requirements. β€” An applicant for an amusement device permit shall:
(1)Β apply to the county commissioners on the form that the county commissioners require for each location where an amusement device is to be operated; and
(2)Β pay a fee of $ 100 for each amusement device.
(c)Β Term of license; renewal. β€”
(1)Β Unless an amusement device permit is renewed for a 1-year term as provided in this subsection, an amusement device permit expires on June 30 after its effective date.
(2)Β An amusement device permit may be renewed each year on or before July 1.

Β§ 17-446. Penalties.
(a)Β In general. β€”
(1)Β A person who violates Β§ 17-443 of this subtitle is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 6 months or a fine not exceeding $ 5,000 or both.
(2)Β A person who violates Β§ 17-444 of this subtitle is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 6 months or a fine not exceeding $ 500 or both.
(b)Β Forfeiture. β€”
(1)Β On conviction for a violation under this part, the county may institute proceedings to seize any amusement device that was operated in violation of this part.
(2)Β The Circuit Court of Washington County has jurisdiction to hear and determine any forfeiture proceeding carried out under this part.
