AP2008-008:  An appeal made by Michael Eby et al for a variance from the 100-ft from an existing structure housing animals to 71-ft on the left side and 89-ft on the right side and variance from the density requirement of 1 dwelling unit per 5.00 acres to 1 dwelling unit per 1.83 acres to create 2 lots for homes that exist on one 3.78 acres parcel, on property owned by the Appellant and located at 17022 Broadfording Road, Hagerstown, Maryland, zoned Agricultural (Rural).  GRANTED 5-0 CONDITION OF 30 ANIMAL MAXIMUM

DOCKET NO:  AP2008-010:  An appeal made by Ronald Cekovich for a special exception to establish a resident business engaged as a retail gun shop, on property owned by the Appellant and located at 13255 Herman Myers Road, Hagerstown, Maryland, zoned Agriculture (Rural)  GRANTED 3-2 WITH CONDITION OF SIGNAGE CAN NOT BE ILLUMINATED AND CAN NOT STATE FIREARM OR AMMUNITION

DOCKET NO:  AP2008-011:  An appeal made by Austin Rice for a special exception to construct a mini storage building facility, on property owned by the Appellant and located at 12021 Itnyre Road  Smithsburg, Maryland, zoned Agricultural.  GRANTED 5-0

DOCKET NO:  AP2008-012:  An appeal made by Fredrick W. Stumpf for a special exception to construct and establish an electrical contractors storage yard and office, on property owned by Homeplace Everlasting Gifts and located at 20519 Beaver Creek Road Hagerstown, Maryland, zoned Rural Village.  At the request of the Appellant, AP2008-012 has been postponed and, therefore, will not be heard at this hearing. When/if the case is rescheduled, the appeal request will be advertised, the property posted and adjacent/confronting property owners will be notified of the new hearing date.
