DOCKET NO. AP2004-154:  CONTINUED DELIBERATIONS UNTIL JANUARY 4, 2006  Pursuant to the Memorandum Opinion issued by Judge Donald E. Beachley in the Circuit Court for Washington County, Maryland on October 14, 2005, this case has been remanded to the Board for further proceedings:  An appeal from the Planning Commission’s determination that a proposed development plat to be improved with one dwelling without public road frontage be denied on property owned by Brian K. Nordyke & wife and located at 8807 Norbeck Drive, zoned Agriculture.

DOCKET NO. AP2005-144:  GRANTED WITH CONDITIONS  An appeal made by Walter Tinkler for a special exception to establish a “dog daycare” kennel facility with outside runways and variance from minimum 400 ft. left side yard setback to 15 ft., 400 ft. right side yard setback to 292 ft. and 400 ft. rear yard setback to 383 ft. from said kennel on property owned by the appellant and located at 8205 Lake Drive, zoned Agricultural (Rural).

DOCKET NO. AP2005-145:  GRANTED WITH CONDITION  An appeal made by Brian D. Gladhill from the Planning Commission’s determination that a proposed Development Plat of Parcel 124 be denied due to inadequate road width under the APFO on property owned by the appellant and located on the north side of Hicksville Road, 500 ft. east of Spickler Road, zoned Agricultural (Rural).

DOCKET NO. AP2005-146 GRANTED WITH CONDITIONS  An appeal made by Kim Ritchey for a variance from minimum 40,000 sq. ft. lot area to 39,522 sq. ft. from existing structure to be converted to a child care center with left side yard setback of 100 ft. to 37 ft. and right side yard of 100 ft. to 50 ft. from said structure and a waiver to allow parking in the side and rear yard areas on property presently owned by Eugene D. Busch and located at 13514 Little Antietam Road, zoned Rural Village.

DOCKET NO. AP2005-147:  GRANTED   An appeal made by Douglas and Anissa Wade for a variance from minimum 40 ft. front yard setback to 37 ft. for construction of an in-law suite on property owned by the appellant and located at 17646 Spielman Road, zoned Agricultural (Rural).

DOCKET NO. AP2005-148:  GRANTED WITH CONDITION  An appeal made by Thomas Wayne Bowman from the Planning Commission’s determination that a proposed three lot subdivision be denied for not meeting the exemption lot criteria set forth in Section 5b.4(a) of the Washington County Zoning Ordinance on property owned by the appellant and located at 12231 Pleasant Valley Road, zoned Environmental Conservation.
